Stratford Council cracks down on tax evasion: Bankruptcy order secured against non-payer

Stratford-on-Avon District Council has sent a stark warning to those who deliberately refuse to pay their council tax: pay what you owe, or face serious legal consequences.

In a bid to recover public funds, the Council has successfully secured a bankruptcy order against a resident who persistently refused to pay over £5,000 in council tax. The case serves as a reminder that while support is available for those in genuine financial hardship, there is zero tolerance for deliberate evasion.

The Latest Ruling

The recent order was granted against Mr. P James of Banbury Road, Warwick, following a history of non-payment dating back to March 2021. Despite previously paying his council tax without issue, payments ceased abruptly, and the resident began returning correspondence and issuing “Freeman of the Land” style arguments – claiming that council tax is a contract he did not consent to.

District Judge ruled that there was “nothing of merit” in these arguments to stop the bankruptcy order. The court confirmed that council tax is a mandatory charge under an Act of Parliament, not a voluntary contract.

The total debt recovered in this case amounts to £5,707.21.

A Pattern of Enforcement

This is not an isolated incident. Earlier this year, the District Council won a similar contested bankruptcy case against a Stratford-upon-Avon resident, Mr. M Spriggs, recovering £6,535.75.

In both instances, the courts firmly rejected arguments that attempted to bypass legal obligations using internet-based pseudo-legal theories.

Councillor Liz Coles, Housing and Customer Services Portfolio Holder, commented on the enforcement action:

“As a District Council, we are committed to supporting residents who are experiencing financial difficulties and will always seek to agree fair payment arrangements wherever possible. Our support is there for those who genuinely need it.

“However, when individuals deliberately refuse or neglect to pay, we will take action to recover public funds. Council tax is essential for funding vital local services, and it is only fair that everyone contributes. Attempts to avoid payment using misleading arguments can ultimately affect our ability to deliver the services residents rely on.”
